The supreme court
After learning that The Texas Court of Criminal Appeals upheld its decision; the lawyers had no other choice but to appeal to the United States Supreme Court. On January 11th 1954, the lawyers finally faced the Supreme Court. Gustavo C. Garcia proceeded and argued that Pete Hernandez trial was not a fair case since the jury had not been a jury of his peers.
The Fourteenth Amendment was used in the Hernandez v. Texas case, to argue that Mexican Americans are protected under the law.
